Privacy Policy

This Privacy Policy explains how EMA Plus, LLC ("EMAPlus," "Company," "we," or "us") collects, uses, discloses, and protects information in connection with our websites, applications, and Software-as-a-Service platform (the “Service”).

 

This Privacy Policy applies to U.S.-based users of the Service. If you do not agree with this Privacy Policy, do not use the Service.

1. Scope and Roles

Account Holders / Business Customers.  If your company creates an account with EMAPlus, your company is the “business customer” and controls what information is uploaded to the Service.

Contacts in a Customer’s CRM.  If you are an individual whose information is stored in the Service by one of our customers (for example, you are that customer’s employee, client, vendor, subcontractor, or project contact), EULAPlus processes your information on behalf of that customer. If you want to exercise privacy rights regarding that information, please contact the customer that collected your information.

2. Information We Collect

We collect information in the following ways:

A. Information you provide directly

  • Account and profile information: name, business email, phone number, company name, username/password, role/permissions.

  • Billing and transaction information: billing contact details, subscription details, payment status, and invoices/receipts. (Payment card information is typically processed by our payment processor rather than stored by EMAPlus.)

  • Customer Data uploaded to the Service: information you or your organization uploads, enters, or otherwise makes available through the Service, which may include business contact information (e.g., names, emails, phone numbers), project and bid details, notes, documents, and communications.

  • Support and communications: information you send us when you contact support or communicate with us.

B. Information collected automatically

  • Device and usage information: log data and diagnostic information such as IP address, device type, browser type, operating system, timestamps, pages/screens viewed, feature usage, and error reports.

  • Cookies and similar technologies: we may use cookies, SDKs, and similar technologies to operate the Service, remember preferences, and understand usage. You can control cookies through your browser settings (some Service features may not function properly if cookies are disabled).

C. Information from integrations and third parties (at your direction)

If you connect the Service to third-party products (e.g., email, calendar, storage, or other business tools), we may receive information from those third parties as authorized by you and your integration settings.

3. How We Use Information

We use information to: 

  • Provide and operate the Service (including authenticating users, processing Customer Data, generating bids/estimates/outputs, and providing customer support).

  • Secure and maintain the Service (including monitoring, preventing fraud/abuse, debugging, and enforcing our Terms).

  • Improve and develop the Service (including analyzing performance and usage trends).

  • Communicate with you about service-related notices, updates, security alerts, and support responses.

  • Process payments and manage subscriptions.

4. De-Identified Date and Analytics

We may create de-identified and/or aggregated data from Customer Data and Service usage data. We use this de-identified data for internal business purposes such as analytics, benchmarking, product improvement, and improving our estimation methods and models.

We may disclose information as follows:

  • Service providers (processors): vendors who help us host, operate, secure, support, analyze, and bill for the Service (e.g., cloud hosting, customer support tools, analytics, and payment processing). They are permitted to process information only for providing services to EMAPlus.

  • At your direction (integrations): when you choose to connect third-party services, we disclose information as directed by your settings and instructions.

  • Legal and safety: to comply with law, protect rights and safety, investigate fraud/security issues, or respond to lawful requests.

  • Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets (subject to this Privacy Policy as updated).

  • With your consent: when you ask us to share information.

6. Sale or Sharing of Personal Information

We may share or sell certain personally identifiable information (such as your name, contact details, demographic information, or online activity data) with third parties, including marketing partners, advertisers, and data brokers, for the purpose of delivering targeted advertising, promotional communications, or other marketing services. This sharing may be considered a “sale” of personal information under applicable state privacy laws. You may have the right to opt out of such sales at any time by following the instructions provided in the “Your Privacy Rights” section of this Privacy Policy.

We retain personal information for as long as reasonably necessary to provide the Service, comply with legal obligations, resolve disputes, enforce agreements, and for legitimate business purposes. Business customers may be able to export or delete certain Customer Data through the Service or by contacting us.

8. Security

We use administrative, technical, and physical safeguards designed to protect information. No security measures are perfect, and we cannot guarantee absolute security.

9. Children's Policy

The Service is not directed to children, and we do not knowingly collect personal information from individuals under 18.

10. Your Privacy Rights (U.S.)

Depending on where you live, you may have rights such as:

  • requesting access to personal information we maintain about you;

  • requesting deletion;

  • requesting correction;

  • opting out of certain processing (where applicable); and

  • appealing certain decisions (in some states).

  • California (CCPA/CPRA). If you are a California resident, you may have the right to request: (a) to know/access, (b) deletion, (c) correction, and (d) to opt out of selling/sharing (if applicable). California authorities also explain that an online-only business with a direct relationship with the consumer may provide an email address as a method for submitting requests.

How to exercise rights. Submit a request by emailing us at: connect@emaplus.net. We will verify your request as required by law. If we cannot verify, we may deny the request.

Authorized agents (California). You may designate an authorized agent to make a request on your behalf, subject to verification and proof of authorization.

Non-discrimination. We will not unlawfully discriminate against you for exercising your privacy rights.

11. Updates to This Privacy Policy

We may update this Privacy Policy from time to time. The “Effective Date” above indicates when it was last revised. If changes are material, we will provide notice consistent with applicable law.
